The agreement has two objectives. First, it allows the landlord and tenant to list the details of the lease, such as the names of the parties, the duration of the contract, the amount of the rent and how the payments are to be made. Contractual terms can only be changed with the written agreement of the landlord and tenant. There is no minimum or maximum duration of the agreement under the Western Australia Act. Before the lease expires, you do not have to respect the owner`s intention to renew the lease. The termination must take place some time before the expiry of the tenancy agreement, as required by law in your jurisdiction. This period is called “notice.” As a general rule, the termination period is one month for leases of one month or less and two or three months for leases longer than one month, but this varies by jurisdiction. You should consult the statutes of jurisdiction in which the property is located in order to know the necessary notice period for your lease. The parts of a tenancy agreement are the landlord, also called landlord, and the tenant, also called tenant.

The landlord owns the property and allows the tenant to use the property for monetary policy payments called rents. Fire safety and evacuation (No. 59.18.060) – After the rental begins, the landlord must provide the tenant with a copy of safety/fire information, including an evacuation plan. This should apply when accommodation has a smoking policy, an emergency plan and the route (s) to leave the building in the event of a fire. Only tenants and persons registered as occupiers may reside in the premises. The landlord must be informed and approved of any changes to the list of authorized tenants. Children born or adopted while the tenant resides in the premises are automatically included in the rental agreement as tenants. In addition, any jurisdiction may limit the number of tenants or occupants in the premises if this number is contrary to the health or safety standards applicable to the dwellings. Health and safety standards are generally expressed in 1 person per square metre X. The standard varies from jurisdiction to jurisdiction, so if you are concerned, contact your local housing/health agency.

The standard form agreement not only provides room for relevant details, but it also easily lists the standard terms that must apply to all agreements under Western Australian law. If the contract is written, the owners must provide each tenant with a copy of the contract when the contract is signed. The “law” refers to the legislation relating to leases in your country. After choosing the location of the property by filling out the details of the lease, you will see under your selection a link to the applicable legislation for the jurisdiction you have chosen. It is not necessary to explicitly state the name of the “law” in your contract, as the corresponding legislation is satisfactorily characterized by the “severability” clause of your lease. The tenant`s obligations are defined by this rental agreement and the specific laws for the location of the property. The tenant`s main obligations are to pay the rent on time and not to cause damage to the premises.
